Minor child served theft summons by step parent living in same home as minor while biological father is away in mexico with his son and step daughter without permission of court prental custody is on file nor did father inform other parent there are other juvinille cases pending of said minor and she has gone through all procedures without legal representation, in the illinois juvinille summons served a restraining order is mentioned does the child have to remain in the residancy of the step mom and biological father and what actions can be done to have her placed out of state with biological mother and or temporarily with closer relitives auns in wisconsin also father is under investigation for child abuse on children through dcfs mchenry county is juristiction on all the above need advice asap!!!

wow, sounds like there is a lot going on here. First, to remove a minor, you need to go to the court and petition for a change of custody. If it is an emergency, you still file that, but you do it in a special way so you are heard in court earlier. The court will look at the entire situation and decide what's in the best interest of the child. From what you describe this is a matter that should be heard immediately.
