Legal Question in Family Law in Illinois

Ex wants kids because of deployments

I am active duty and when I deploy for 4 months at a time, the ex thinks she should have custody of the kids. I have sole custody of them, she only has visitation. I am remarried and the kids have good relationship with their step mom, they all do great in school when I am gone, they have never had any problems when I have deployed. What is the best route to keeping her from being able to get the kids? She kidnapped them last year while I was gone, and just last month the charges were dropped.

Need some answers fast.

I agree with the previous answer. Also, the fact that your ex was charged criminally with kidnapping the last time you were deployed does not help her in seeking even temporary custody.

I don't know what branch of service you're in, but "Semper Fi" from an old Marine.

Hello. The court order speaks for itself. While you are deployed your wife should have a certified copy of the court order in her possession. Should mom attempt to take the children and keep them, your wife should immediately call the police. Until mom decides to go to court and seek to adjust custody while you are deployed, the present court order controls.
