can a lawyer legally sign a final custody agreement for the plaintiff and have it hold up if the plaintiff doesn't return the child from another state when the agreement says

It is highly unusual for an attorney to sign a custody agreement. Courts usually want a party's signature, to prevent the argument that the attorney did not have the authority to sign the document. But specific facts may support the signature. For the attorney's sake, I hope he/she has the written authority of the client to sign the document.
