Legal Question in Family Law in Illinois

Legal custody with no divorce decree

My wife and I are separated yet still living together. We have 2 girls together and 1 son her former marriage that I adopted over 3 years ago. I would like to accept a job in Georgia, and I would like to take the children with me. However, I would like to give her son a choice, since he is almost 10 years old. We have been married for almost 5 years, and there is no custodial or divorce decree. Do I need her permission to do this? What are my options?

Re: Legal custody with no divorce decree

Why don't you get a divorce and get a custody decree in place. She does have rights with regards the children and agreements are better than leaving and then having to deal with all those issues down the line.
