Legal Question in Family Law in Illinois

Need legal representation regarding child support. Currently serving in the Military in Oak Harbor. My case is in Chicago. I need a attorney to represent me in court providing I can't appear due to my active duty. It's is a simple cut and dry case. My Ex has served me papers saying that I am in default of my payments (which are deducted auto from my check monthly) and being dishonest of my income. I have all documents saying I AM NOT!! in default. I am required to submit papers every year regarding my income. My documents show all up to date in payments and NO MONEY is past due.

Your question doesn't state whether it's a IV-D case or judicial. If it's IV-D, you will EASILY be able to get an accounting, which you can hand to the State's Attorney. If it's Judicial (No C number), then could be different story - however if you were wise, everything you made went through Illinois' SDU system. If it did not, then we have our work cut out for us.

An attorney can cover for you on all days EXCEPT a hearing date. If it's "cut & dry," then typically my way of handling it (and it will differ from attorney to attorney) is let the judge know you're overseas and ask for a pre-trial on the issue.

Keep in mind the specific facts of the case dictate what needs to be done. Contact the Chicago Bar Association for an affordable referral - ask for someone who's been in the service, because civilians don't know how to read an LES properly.
