Legal Question in Family Law in Illinois

i would like to know what my legal rights are to my sons custody. my exwife had custody then she was sentanced to 5 years in the penitentary where then my son was gave to me . i would like to know what i need to do to keep it this way or if she even has any rights any more?

I do not know enough information, but I would make sure you have permanent custody.

When your wife gets sent to the penitentiary, the law provides you get custody, but it is done by a court order and no just by operation of law. You need to file a Petition with he court setting all this forth and give your X notice.
