Legal Question in Family Law in Illinois

Liability for property purchased during marriage

My husband and I are separating. I'm listed as the primary borrower on his car, and he is the secondary. He wants to trade this car in and purchase a new one, in his name only. Will I still be liable for this new car, because we're still married?

Whatever you can do to get your name off of things jointly do it. As long as the car is solely in his name you're likely okay. Don't use it though...in other words, if possible make it clear that this is indeed his car and not just a "sham" ownership.

If you're indeed separating make sure you've set up some separate accounts and are okay financially. If kids you may want to get child support set-up through court or the state child support enforcement division too.
