Legal Question in Family Law in Illinois

I live in Illinois. I hired an attorney 2 weeks ago for child custody case. The child lives with me and I need the court to finalize it as full custody. I in two weeks lost trust in my attorney. He twice gave a deadline when he was to create the order to file with the court however has not followed through. My concern is the father of my son will take the lead as the petitioner. And i dont trust my attorney will follow through with anything. If i terminate him csn i receive any funds back even tho contract states non refundable retainer. I need an attorney but cant afford another 1500. He only spent an hour of services so am i entitled to remainder. Or am i stuck with him as my attorney

It is unethical to have a non-refundable retainer in a divorce case, However, he may have spent more time than you may think on your case. You certainly will not get your entire fee back, but it probably is in the attorney's best interest to refund some of the fee, as nothing appears to have been filed in court on your behalf.
