If you have been a party to a divorce or a parentage case, you are prohibited from leaving the state without a court order. You are required to file a Petition to Remove, which is what the pleading is called,. You must state in the motion why you need to leave the state, why it is in your best interest and that of the child(ren) and what effect the removal will have on the other side's visitation, and what you are offering for alternative visitation. You must mail a copy of that motion to the other side and obtain a court date, present your motion to the court, which will eventually rule on it, unless an agreement is reached, which should be put into an order.
