Legal Question in Family Law in Illinois

can living with another person affect custody

After my husband cheated on me in December of 2005 things progressively got worse and worse between us. I finally left him in May of 2007 but neither of us have been able to afford a divorce. I have since met someone else who I care about deeply. He is wonderful with my son and my son adores him. My lease is up on July 1st of this year and I am considering having my new boyfriend move in with me. I am hesitant because I am still legally married and am worried that living with another man may look bad if our case goes to court in regards to custody of our son. Do you think I have anything to worry about? Once we can afford the divorce we had planned to just use a mediator and decide things on our own. I would like joint custody (for the benefit of my son) but if my Ex takes me to court for sole custody (because I live with another man)then I will fight for Sole custody myself. Thanks for the help.

Re: can living with another person affect custody

Real simple: Get a divorce. If you cannot afford to get a divorce, you cannot afford to get in a new relationship. You are just asking for trouble. As for sole custody, you will not get it unless the father is a truly dangerous person. Shouldn't you clean up your past before getting in another relationship?
