Legal Question in Family Law in Illinois

Living Trust-sufficient enough?

I've asked a few times, no responses. I was married and now divorced. Reason for divorce...his 1st wife destroyed us. Took us thru a 3 year court battle trying to get MY house, pension, etc. and to get me to pay child support.

we realize now that that was the reason for our marriage ending, although at the time, didnt see it that clearly.

my question is - if we remarried, would a living trust be sufficient to protect me if she decided to attack again?

thank you.

Re: Living Trust-sufficient enough?

I believe that I answered this question a while back. First of all, the ex has no right or claim to your property. Second, a living trust will provide some protection. However, in some limited circumstances, a creditor can attack the trust. I don't believe an ex can attack your living trust. Once all of your property is in the trust, the trust owns the property. I would put the property in a living trust. This answer is not to be construed as legal advice. It is merely an answer to a very limited question. Please seek the advice of a lawyer for legal advice.
