Legal Question in Family Law in Illinois

This is a long question,but must explain. My grandaughter is 13 1/2 years old. I am her grandaughter.

I raised her fro 1 mo old till she was about 8 years old. I had custody of her through court.My son decided that he wanted her so he took me to court and got custody of her. She was with him until about a little over a year ago and she went to live with her mother. Now her mother has had her since Jan of 2009. over a year. My grandaughter would rather be with me then anyone.

Ok Now her mother is moving back to the town where they were living before and my grandaughter doesn

t want to move back there. She wants to live with me and stay in the school she is in now. She wasn

t doing good in the school before but now where she is at,she is making very good grades to what she was before with her Dad,which is my son. Her mother says it is ok for her to live with me(my son has custody which was never changed in the courts when she went to live with her mother)

Can my son keep her from moving with me if that is what her mother and me want??? need a answer to this problem Thank you. any questions please ask me.

Yes - your son has custody - you have no meaningful rights to custody of your granddaughter. Your daughter would have to seek a custody order from a court that would have jurisdiction, It is unclear if these places are in Illinois or different states, which complicates matters even more.
