Legal Question in Family Law in Illinois

lowering child support

Is it possible to have the child support you pay lowered because you are barely getting by? I have another child with my fiance, the custodial parent is now married (which her new last name never shows up on the child support letters), and the child resides with the grandmother of the custodial parent and not with the mother. Is there anything to do??

Re: lowering child support

Hello. You are definitely entitled to relief. The custodial parent should not be receiving child support if the your child resides with the grandmother. It sounds as if the child support order needs to be modified right away. Also, you may want to consider getting custody of your child. Grandma has no right to have your child reside with her. Its your child, and if mom can't handle being a mom, in my opinion, you may want to seek custody. Will be happy to discuss this further and in more detail.
