Legal Question in Family Law in Illinois

Married in US and now out of country permanently

I am married to a US citizen (girl), she had extra marital affairs and she deserted me couple of times. We got separated in February 2007 and I applied for my divorce but she did not sign the papers to bother me. I was sad enough to leave US permanently. I also did not recieve my green card but I do not care for it anymore because of my cheater wife. I left US in May 2007 and now I am in Pakistan and want to get a divorce from her, even though she might not sign the papers as she did not before. Please tell me the solution. I was living in Illinois when I left US. If I want to marry some one else who is other american or canadian, then I have to have a proper divorce but if she do not sign the papers, how can I get it done?

Re: Married in US and now out of country permanently

Hello. In my opinion, since you now

reside in Pakistan, Pakistan is where

you should file for divorce, according

to what the laws of Pakistan allow. To get an Illinois divorce you would have to reside here for at least 90 days prior to the time that you file

for divorce in Illinois. When you

made your permanent move, your residency in Illinois ended. Your wife could file for divorce against you here in Illinois, assuming she is

still an Illinois residence. I hope my comments will be of some assistance to you. Will be happy to

discuss this further should my comments cause you to have any more questions about how your situation relates to Illinois law.
