I you were to get married in the state of Nevada and you live in the state of Illinois could you optain a divorce in Illinois or would you need one from the state of Nevada?

Hello. If you are a resident of Illinois, you need at least 90 days of residency in Illinois before you can file for a divorce against your spouse regardless of where they live. In fact the petition for dissolution of marriage must state that the person bringing the petition has been a resident of illinois for at least 90 days as of the filing of the petition. You would file in IL. You do NOT need to live in Illinois for 90 days prior to filing for divorce. You only need to live in IL for 90 days prior to COMPLETING the divorce. So you can file the day you move here as long as you prove up/finish the divorce after living her 90 days.
