Hello. If you are a resident of Illinois, you need at least 90 days of residency in Illinois before you can file for a divorce against your spouse regardless of where they live. In fact the petition for dissolution of marriage must state that the person bringing the petition has been a resident of illinois for at least 90 days as of the filing of the petition. Will be happy to discuss this further and in more detail.

You would file in IL. You do NOT need to live in Illinois for 90 days prior to filing for divorce. You only need to live in IL for 90 days prior to COMPLETING the divorce. So you can file the day you move here as long as you prove up/finish the divorce after living her 90 days.
