Legal Question in Family Law in Illinois

misusing an order/protection to keep my possessions

My ex-fiance was three times infidel ,I found out. I broke up. She told me she would return my belongings. Then she changed her mind. many times .. She has called me. I have called her only about the return. Now she has filed an order of protection. I can not afford an attorney to take her to court $800 and up , (I have been quoted -min).

She was very abusive(physically) to me towards the end.

She did not take her medications. Her daughters ( both teens) have lied on a

police report saying I hit her( protecting their MOM) ,when in fact it was the other way around.it was dismissed( don't know by who).

The O/P hearing is 8-26-05 I just received the notice yesterday. What can I do to show she is using this to keep my belongings and she and her daughters have lied causing my arrest. There is nothing '' hidden '' in what I have said ! Items she is keeping are from: my tools $1200 , my childrens items they made from kindergarten through high school. Family heirlooms from generations ago.In monetary terms , total about $4000. but many are priceless to me.

Please call me ?? or send an e-mail..

Re: misusing an order/protection to keep my possessions

The smart thing to do is to appear in court on 8/26 with a list of items that the ex is currently keeping from you. Inform the judge that you have asked for these items back numerous times but your ex refuses. Explain to the judge that your ex has no claim on these items and ask the judge to issue an order restraining your ex from getting rid of the items or damaging the items before you have had a chance to pick them up. Explain to the judge that under the circumtances you want a police officer to go with you to the home of your ex to pick up your items. The judge should have no problem with issuing this order and if the judge does then ask the judge how else are you suppose to pick up your items.
