Legal Question in Family Law in Illinois
Modification of visitation
In my divorce judgment three years ago, I was awarded sole custody of my children with the approval of my ex. A visitation schedule was set and has been maintained. I have sinced moved (25 miles) from the ex and now she seeks modification of visitation to include overnights during the week, which was not in the original judgement. Do visitation schedules get modified because one party no longer likes it?

Re: Modification of visitation
Divorce judgments may be modified if there has been a substantial change in circumstances. You moved 25 miles further away which the court may consider a substantial change in circumstances and so modifify the original order. You can contest it but if her request is reasonable and serves the interest of the child, the court will likely grant it.
