Legal Question in Family Law in Illinois

Modify Child Support

My ex owes 61 thousand dollars in support orders...he now wants my daughter to disown him so he no longer can pay this support payments? Is that possible? I need the money. I have two court orders and i am working on taking him back to court.

Re: Modify Child Support

Even if his parental rights were terminated, he'd still owe back support. With that said, terminating parental rights is not up to your daughter. It's not even up to you, unless you have someone waiting in the wings to adopt her.

Re: Modify Child Support

Termination of parental rights can only be done through the courts, and for sound legal reasons, not because he doesn't want to pay back child support. Even if his parental rights were terminated that does not absolve him of paying back child support. There is some law in Illinois that even requires a parent to continue paying child support even though his/her rights were terminated. Get a lawyer and go into court to enforce the court's rulings.
