Legal Question in Family Law in Illinois

Modifying Visitation Rights of Non-Custodial Parent

I am the custodial parent of my 9 year old daughter. Her father and I were never married, we went to court to establish child support and visitation (which is currently every other weekend). We are due to relocate to California at the end of June 2004 and everything is already in place (i.e. job, apartment etc.). Originally her father was to move with us and has since changed his mind but he does not want us to move either. Now he is threatening to sue me for custody of our daughter. I have offered several other options to him for visitation such as summers, school breaks and split holidays etc. He adamantly refuses to negotiate. What measures must I take in order to be able to relocate and meet his visitation rights? Also, can he actually take custody away from me based on my wanting to relocate? I need help ASAP as the move is barely a month away. Thank you for your assistance.

You should file a motion for removal. The standard is what is in the best interest of the child. I can help you with this process. It could take some time to complete. Please call me for a free sconsultation.
