Legal Question in Family Law in Illinois

My mom and dad have been separated for at least 10 years. They have never filed for legal separation. We live in Illinois. my mom is having health issues. She is wanting to name her sister as her power of attorney. I am trying to find out if she can, do to still being legal married to my dad. They have not lived together for at least 10 years. I was wanting to know if there is a way to have a legal separation declared with out paper work being filed. Thanks

1 - She can name any adult on her health care power.

2 - The only way to have a legal separation is by court order
