Legal Question in Family Law in Illinois

Motion to modift child support

My last day of work is12/31/08 Laid off by the mayor here in Chgo. as a city worker.

Can I get my child support lowered. I am facing potential hardships. I recently married over a year ago and have a new child on the way in the summer. Is it best to file my motion to modify child support payments at a Illinois supreme court or do I have to go to the same judge in family court who had not favored my case before.

I have been victimized by an ex spouse of 24 1/2 years who decided to fabricated a lie, got a court order of protection, to use it to get me kicked out of our apartment, then i lose my daughter to her, kept from her as the protection order stays enforced for 2yrs. Then she succeeds in geting 20% of my income. All of this so that she can engage in a relationship with a guy 20 yrs younger. Needless to say it didn't work 4 yrs ago. My ex is a master of deception at using an honest court system to gain her treasure through deceit and now i suffer because the judge gave me almost no real effort to allow me to present my case and the attorney I had in short drained my finances from the day I used him in my divorce case.

Can someone tell how to make at least a small step forward that will minimize my hardships. Thanks!

Re: Motion to modift child support

Well you have to file the case at the trial court level...Supreme Court is not an option. There are circumstances where you can change judges but it becomes more difficult if your judge has previously made substantive rulings in your case.

As long as you've legitimately lost your position, get a good, solid paper trail before your position ends showing the unemployment is involuntary. This should be a fairly basic and winnable case.
