Legal Question in Family Law in Illinois
I want to move to a neighboring state with my daughter to live where my family lives. My husband is saying I have to stay in this state (Illinois). We haven't filed for divorce/custody yet, he is abusive and threatens to take my daughter from me if I leave with her. All of my family is in Missouri and I have more access to employment there. Can he keep me from moving to another state?

If there is no case pending or filed, then you can move to another state. These cases may become very contested. You should seek the help of an attorney to navigate the potential land mines. If you would like to speak to me regarding the issue please call 312-715-0870 and ask for Kimberly Anderson and if you would like to know more about me please go to www.illinoislawforyou.com and see my attorney profile.
I respectfully disagree with the prior post. I recommend to people in your situation to address the issue of removal before leaving. If you simply leave, then the father can file a case to force you back to Illinois and you will be fighting a case filed in IL while you are living in MO. On the other hand, if you move without first getting permission from the court, and the father never contests it, then you are in the clear. Of course, there are is lot of helpful information that would allow me to give you more specific advice. Feel free to contact me if you have any additional questions.
