Can I move out of state with my child if I have custodial guardianship?

I divorced my husband in 1994. We got joint custody of our daughter and he was to pay me $65.00 a month in child support. We got back together in 1995 and since he has been unfaithful and is depriving our daughter attention. She is 10 almost 11 years old now and she is not happy here either. I would like to move out of state with her and still give him rights to see her anytime he wants but in our divorce agreement, i wasnt even allowed to leave the town we both resided in. The agreement stated we were to reside in Chillcothe Illinois and when my daughter turned 12 we could go in front of a mediator and she could decide for herself who she wants to live with. But i want to leave the state of Illinois and reside in Minn. How can i do this or can i do this? Thank you

You need to petition the court for permission to take the child outside the state. You must prove that it will be better for the child.
