Can I move out of state with my child?

I live in Texas with my knew boyfriend and my children, my husband lives in Illinois. He is telling me that he is talking to a lawyer to get divorced but I have not heard from any lawyers. My question is, Can I move out of state with our child? He does not pay child support and he is a truck driver. He is also telling me that he will go to court and everything and I will not know anything about it.

You need to file the divorce here in Texas, the residence of the children. It will make the proceedings less complicated. The court will determine what child support and visitation is appropriate, as well as a division of the debts and assets. Getting service of process on him may be difficult, but not impossible. Since there is no court order in effect now which restricts the residence of the children, you are able to move with them. TCL
