noncustodial parent moves out of state
I have primary residency of my daughter, I live in IL, her mother recently moved to AZ and now wants to fight for primary residency. Does she have a chance considering she moved so far away?

the same determination exists regardless of where the parents live for the most part. If you got custody the first time, you are looking good for the next eval. Also, her desire to get sole custody and move the child out of your state will be seen as selfish. Just play it safe and treat this petition was complete seriousness.

The state where the custody issue is litigated is the state in which the child has lived for the last 6 months. So it would be litigated in Illinois, probably before the same judge as the original custody case came before.
