Non-minor child educational expenses 2

Ben, the original divorce order included tuition, fees, etc. insurance, 60% remaining medical expenses for my oldest 2 sons. That order required full time attendance. I appealed other matters and lost. Daugher in 8th grade's college not included. New petition filed and new judge stated previous order should be followed for 3rd child but won't include language requiring full time status. Concern is ex owed me 20,000 when last child graduates or quits college and intention to have attend part time for years to postpone other payment. Also, coverage much more expensive with policies other than for full-time college status. My hope is that there is some previous case or interpretation that would require daughter maintain full time or my payments for her expenses, including living, tuition, insurance and medical would cease.

It has been my experience that if a parent cannot cover the child on their own insurance, due to the child not being a student or eligible that, that the parent is no longer obligated because the child qualifies as emancipated. With that said, you may want to make sure the court order specifically says that. If it doesn't, you should go to court to make sure that is the case.
