Legal Question in Family Law in Illinois
My oldest daughter has moved in with my ex husband. He now wants the child support changed and has gotten an attorney. His attorney sent me an email at work "Please provide the office with detailed information such as ( full name, dob, employer, current pay stubs, address etc). We intend to draft the documents ASAP & will send you a copy for review." Is this all they need to do or should there be an official request in writing by mail. I just feel this is a little strange. Also, I have 1 child and he has 1 child now...will paychecks be compared and the difference still expected to be paid? We live in the state of Illinois.

First of all, the letter seems totally appropriate. What they appear to be doing is preparing the necessary papers to modify the support. There is no set rule or statute on how support is to be calculated when each parent has one child. One way if to take 20% of each person's income and the difference is what should be paid. I would hope that they are attempting to save money and time in resolving this issue.
