Legal Question in Family Law in Illinois

what are my options?

my wife and i want a legal separation where we both have 50/50 custody without having child support as a factor. are there options to achieve that, or should i fight for full custody. she left for another guy, and i dont feel my son is in a safe environment as the guy has a short fuse and i dont know him that well and i want my sons safety first. there is no stability over there and he would be stable here in his legal residence with me. what are my options?

Re: what are my options?

Hello. Your best options could be to file for

divorce and seek custody of your son. From your

description of your wife's living arrangements it

would seem that it would be in your child's best

interest to live with you and have mom pay child

support. I suggests that you move on this

quickly in your child's best interest. Will be

happy to answer any additional questions you may

have.
