Legal Question in Family Law in Illinois
Do I owe child support ?
My sons father and I have joint custody. It was established 4 years ago, in court. In the paper work it states that neither I, nor my sons father, pay child support. My son is staying at his fathers primarily during the school year. My son is on the medical card and Public Aide is taking me to court to order me to pay child support as long as he is on the medical card.
I live in a rural area with my boyfriend and our two year old daughter. I am a stay at home mom and do not have a drivers license. Public Aide said they are going to force me to work, when the suspension is over, and pay child support. Public Aide said it doesn't matter what was established in court 4 years ago because it has been a long time. Can they force me to work and pay child support when it is established in court neither of us has to pay child support?
Thank You.

Re: Do I owe child support ?
Hello. A court order is what matters. However,
the Illinois Department of Public Aid is apparently intervening in your case and is asking
the court to amend the order and order you to
pay child support. First of all, you need a
lawyer like yesterday. You can and should fight
this. Public Aid is attempting to save the State
of Illinois money. If you have to pay, dad should pay as well. This is a serious matter. I
suggests that you act quickly. I will be happy
to answer any additional questions that you may
have.
