Legal Question in Family Law in Illinois

Paternity Actions

My friend will be having a paternity test in January. The child is 3 years old. He would like to know when he should seek legal council, before the test or after; and what are his rights and responsibilities if he is proven to be the father.

Re: Paternity Actions

Hello. Your friend needs a lawyer

now, before the paternity test. No

test exists which can determine paternity 100%. The test is whether

a man will be excluded as father since

so many other characteristics do not

match up. Even if a man is not

excluded from paternity by the test,

the man is still entitled to a trial

if he contests paternity. At this

stage the man would have to prove by

clear and convincing evidence that

he is not the father of the child. I

will be happy to discuss this with

you further.
