Legal Question in Family Law in Illinois

Paternity Situation

Right before my mother died, she revealed who my real father is. It is a man that I worked for during much of my 20s & 30s (I am 50 now). He had 2 sons, one older than me & one younger. She evidently kept it a secret since he was married.

Although I have not approached my biological father about this yet, I have talked to his sister. To my surprise, it was common knowledge to her and her sisters that their brother was my Dad. Also, it is starting to look like my half brothers probably knew as well, judging by how they treated me.

When I look back, my boss (Dad) always treated me a little bit better than the other regular workers, but I thought that it was just because I was a good worker. He founded an asphalt and sealing corporation and I worked for it for quite some time, he always made sure that I had a job. Then, I had a major falling out with his sons, whom now have ownership of the business. I then stopped working for them.

That leads me to my questions. First, can I make my biological father take a blood test to prove that he is my father? And second, if he is my father, do I have any right to any part of the business or money generated from it? It went from nothing to a now multi-million dollar business.

Re: Paternity Situation

You probably don't have any rights to his business, but you certainly are an heir when he passes away. You might approach him about this and find out if he'll acknowledge you. Otherwise, you may have to hire an attorney to press your rights.
