Legal Question in Family Law in Illinois

Paternity Testing

I was named as a possible father by my former girlfriend when she got pregnant. She did not want to go to court, but just wanted a paternity test done after the baby was born. Both I and another alleged father have paid for our share of the paternity test, which was done in December of 2002. She is now refusing to pay her part of the paternity test, which she is in collections for. She has told me and the DNA Lab that did the tests that she will not pay this sum, even though it is in collections. Is there any cheap legal way to deal with this problem and force her to pay her portion so that I can get the results of the test?

Re: Paternity Testing

You can only try to enforce the oral contract, however, you may have a hard time. The only other thing you could do is pay for it yourself and then sue her for the balance on the basis of the oral contract.
