pension benefits

Living together 14yrs, legally married 8yrs, does my soon to be ex have a right to my 401k and pension, which he never contributed to.

The short answer is that it depends. Retirement plans are often meant to support married couples so when the married couples divorce, they both want a share of the money they were planning to retire on. If your ex has his own retirement plan you might be in a position to just agree to leave each other's 401K money alone, but divorce courts have a way of including everything when they divide assets.
