Legal Question in Family Law in Illinois

pension and disabilty

I have been in a rough marriage for 13 years. If we divorce, am I entitled to any portion of his retirement pensions and his disabilty? My earning power is very low due to poor health.

Re: pension and disabilty

Simple: you get half of what he earned during the marriage. Maybe more if you can show hardship. I am dealing with a case right now where 95% of the marital net worth is the pension. If my client, the wife, did not get half, how is she supposed to live? Let me know if you have any other questions.
