Legal Question in Family Law in Illinois

Perjury on a divorce decree

If one or more persons lies about the facts on a divorce decree is it a legal divorce? And if that person remarries is he a bigamist. A married couple who were getting divorced lied on their divorce by saying there were no children born of their union. In fact there was a child and that child has since been adopted and the parents' legal rights revoked. So by stating there was no child born of their union are they in fact perjuring themselves and therefore making their divorce decree illegal?

Re: Perjury on a divorce decree

The divorce decree is legal,

however the parties committed

perjury. Setting aside a judgment

based upon material misrepresentation

by both parties would have to be

done within 30 days of the judgment.
