Legal Question in Family Law in Illinois

When should I petition for child support?

My un-born child's father is still in college, unemployed and will not graduate for another 2-3 years. Should I petition for child support before my son is born, after the birth or wait until after the father has graduated college? Can the support order be changed after he graduates to reflect his changed earning potential?

Re: When should I petition for child support?

Well, you do not have a child (legally) until it is born right? So you cannot get child support until the child is born. Don't worry, you can get back support as of the moment it is born. And you certainly can (and should) petition for change in child support upon graduation of the father. Feel free to follow up with other questions, and good luck with the pregnancy.
