police won't jail teen with substance abuse

My 15 year old son drinks and smokes pot. The cops either makes either me or my husband pick him up or they bring him home. When we ask that they lock him up they say I will be arested. We have him talking to a substance abuse councelor but it isn't doing anygood. He leaves the house and does what ever he wants.

Wait until he does something (striking parent, smoking pot, or anything else illegal) and have him arrested.
