Legal Question in Family Law in Illinois

Post Divorce issue.

In our daughters divorce decree it was stated that she was intitled to 1/2 of her x husbands retirement account when he took it out. He left Illinois with the whole $50,000 and didnt notify her. He moved to Ca. and bought a home with his gay partner. He has custody of daughter who is now 25. Our daughter payed everymonth per her wage deduction and it went to her x husband to an approx. total of $13,000 (the agreed amt.)

Now she asked for a hearing in Cook, Co. Illinois on April 20th. This will be her third request for a hearing. Her x husband never appeared. The judge during the past hearing in Dec. said if he didn't appear this time she will win the case. She can't afford an attorney to represent her. She can't even buy the plane ticket until her next pay check. His lawyer has sent her paperwork asking for the evidence for the case which he has because it was in the divorce paperwork and the payroll deductions statements. She wants to avoid a continuence by all means. Loss of work in her job teaching Spec Ed. in Ca is too expensive. He has found ways to close her banking account, allienated her children through countless lies . She just wants what is due her. Does she have to hire an attorney to represent her?

Hello. I strongly suggests that your daughter hire a lawyer. In my opinion, she is at a psychological disadvantage trying to represent herself. Cook County is a very complicated court system and you need someone with experience to help you get the relief that your daughter needs.
