Legal Question in Family Law in Illinois
post nuptial agreement
I have post nuptial agreement prepared by an attorney and my husband and I later went on the same week to norary and had that notarized. I don't have any property but I was worried about my penssion and 401k. We just live together have kid but have no relationship and he never support my daughter neither me I spend all the money for me and her so I wanted to make sure If we get divorced he does not get a penny from my hard work that is for my daughter. in eleven yrs period he never even paid any bill till we had that agreement. so I have a same question If I ask for a divorce. that agreement is valid and forced and he can't touch my 401k or if the divorce is mutually than it's only forceable. thanks.
