Legal Question in Family Law in Illinois
postponing issues involving unborn child
I am pregnant, is there anything that must be mentioned about the baby in the marital settlement agreement or not, since the baby is not born yet. Does there have to be a parenting agreement prepared as well? thank you

Re: postponing issues involving unborn child
You cannot finalize a divorce while you are pregnant unless the father is willing to sign a document stating that he is the father as part of the dissolution. That is a hard sell usually. If the child is the ex-husband's, then yes of course. He is one of the parents, and has a constitutional right to see his child, even if he is not living with the other parent. That is not to say that you can convince a judge that it would be best for the man to not see the child. Depends on your situation.
