Legal Question in Family Law in Illinois

prenuptual agreement question

If marrying someone that has a very very vindictive ex, how can I protect myself from her coming after my assests, income, etc. and avoiding legal fees in the event that she does try? Does a pre nup cover everything of mine and avoiding anyone (ex) from running me thru the ringer in court. I know for a fact that she tried this with his second wife already and that's why they divorced. she did not receive anything, but it destroyed their marriage and there were huge legal fees.

Re: prenuptual agreement question

Hello and Happy New Year. Under these

circumstances, I suggests that you do have a prenuptial agreement. It should outline what property is solely

yours and the fact that your husband

will be solely responsible for any litigation growing out of his previous

marriage. It is very important the

language be precise. I will be happy

to discuss this with you further and

in more detail.

Re: prenuptual agreement question

You should put your property in a revokable living trust. That way you are the trustee and beneficiary. Your husband's creditors and ex wife cannot touch anything in the trust. Please call fior an appointment.
