Legal Question in Family Law in Illinois
Pro se hearing coming soon
I have joint physical and legal custody of my 2 children(10 and 12) Ex wife now is getting remarried to a apparently wealthy (Millions) man. she has voulantarily stopped working and is being supported by this man. based on my 50,000 a year job can his financial records be discovered if he is supporting her to stop my child support to her??? i have a pro se hearing next week how would you recommend i approach the judge to get a reduction or halt in child support. my thoughts was to approach her atty to see if they would agree in a child support stoppage if not i would proceed to discover his and her financial records and assets. and compare them to mine and let the judge make a determination. and again will the judge take into consideration his financial and presently her financial status? the other issue which started me to request this hearing is she without my agreement started them in another school dist. which would add another 1 hour commute each way for me to get them to and from school. my stance is also going to be that just because she moves to another town i should not have to incur additional expenses.

Your question is a bit confusing. I am assuming that since you are paying child support, your ex is the residential parent according to the dissolution Judgment. If so, she can marry a millionaire, and it does not affect what you have to pay. The IL statute is clear on that. You pay 28% of net income, and deviations are rare.

This situation is complex and would require me to review the existing order for child support, can you send it to me?
