Proof of Paternity
My son, who has never been married, has a daughter who is 4 years old. His name is on her birth certificate but paternity was never established in court. He was added to the birth certificate when his daughter was six months old. Does he need to go to court to establish paternity or does his name on the birth certificate automatically establish his paternity?

Hello. In my opinion, your son should file a Parentage Petition so that he can legally be declared the father of his daughter. Otherwise, he has no legal rights to the child and the mother can leave the state, without his permission, if she chooses to do so. At this time, he has no legal rights to see his daughter, if the mother in fact takes steps to deny him visitation. It is in his best interest and in the best interest of the child to act quickly.
