Legal Question in Family Law in Illinois

Protection order / child support

Life has been a living nightmare for my children and I since I ended my relationship with my ex. He either wants to see me dead or jailed. His harrassment, threats and stalking drove me away from my job and home. Despite the distance he's flown from out of town to be in court (in my state)and keep me from coming. At one point, his parent's virtually held me and the kids hostage to keep me from going to court (during which allowed him time to file for custody where he resides, a couple days before I filed for child support ). Next, he filed our son missing with a nat'l missing children's agency. When I contacted the police they told me to notify the sherriff's dept. & FBI in his state. After being routed to the homicide dept. I figured a lawyer should be handling it. The most recent order of protection I obtained has expired. The last court date, he threatened me not to show up and I didn't. Now another court date is coming up & he's trying to get the local police to give him answers about me. My brother recently filed a phone harrassment police report because he's trying to use him to get to me. Can my ex gain report info (like address, phone)? Can I stop pursuing child support, if so how? I just want peace for my kids and I.

Re: Protection order / child support

Hello. Your ex's behavior warrants you making a police report and taking the police report to the State's Attorney in the county where you live and asking them if they will file criminal charges against your husband for stalking and whatever other charges they may want to bring. This is a very serious matter. An order of protection is great, but your ex has taken this to the next level. I suggests you take immediate action.

Re: Protection order / child support

I find it hard to believe that you are going through all this without filing the appropriate paperwork. If I was presented with your scenario, I would file an emergency motion and be in court the next day for an order for protection and have this nonsense stopped immediately. The other issue is that you want your ex's actions on the record so he builds a trail of bad conduct. Assuming what you said is accurate, you should have no problem getting child support and peace of mind at the same time.
