Legal Question in Family Law in Illinois
Protective custody
We, the grandparents, have temporary custody our grandchildren via a notorized document written by the parents. The parents live in Illinios and charges of sexual incounter were levied on the stepfather in connection with the 11 year old female who was 5 at the time of the incounter. They are now in the process of clearing the criminal case while the State of Illinios is persuing juvenile prosecution in the case. The child does not wish to return home to the parents under any circumstances. Do, we as grandparents and temporary custody guardians, have the right to demand a court order insuring a stable environment for the child and has the 11 year the right to choose her place of residence if she fears reprocussions as a result of the charges?

Re: Protective custody
This is information and not legal advice. Wisconsin MAY be the appropriate jurisdiction for you to have standing to file custody proceedings. An attorney for the child may be appointed here to express to the Court her wishes. I strongly urge you to seek legal counsel as it is extremely complicated. A number of questions have to be asked and answered to give you good advice. The Yellow Pages is a good place to start as SOON AS POSSIBLE with some free phone consultations. Only speak with attorneys concentrating in family law. Good luck,
