According to my marital settlement agreement, husbands attorney shall prepare the necessary QDROs. I am the husband. I represented myself Pro-SE. My wifes attorney submitted the QDROs . I believe the amount granted to my ex is wrong. According to the marital agreement , the formula to be used is as follows; A/B X 1/2 C. He submitted 50% of the amount accurred during the marriage. His way gives my EX an additional $16,000. I have a motion to vacate the QDRO, to be heard in June. The grounds I listed for vacating the QDROs are as follows; The petitioners attorney never filed a motion or a petition with the court to be able file the QDROs, the QDROs are not consisttent with the formula as stated in the marital agreement. My ex-wife is not acting in good faith with other articles in the agreement, owes me money from the last joint tax return and refuses to pay me. We have one last joint asset , as in land property, ordered to be put on the market to be sold by the marital agreement., refuses to sell at a fair market price. My Question is this; is my ex-wifes attorney and my ex-wife in contempt of court for submitting and having the court approve the QDROs? Also he didn't give proper notice of the court date, when QDROs approved.
