Legal Question in Family Law in Illinois

Question about contempt

I was divorced in illinois. We were granted joint custody and we were ordered that we were NOT allowed to take the children out of the state without written permission from the other party or the court. My ex took the children to mississippi without permission from anyone. is that a violation of court orders? I never lived in illinois, As I live in missouri. Is there anything I can do about it? And if there is, how long do I have to file a motion or whatever it is I need? Thank you

Re: Question about contempt

Hello. Happy to answer your question. Your

ex definitely violated the Court order. A

petition for rule to show cause should be filed

and of course the motion and notice need to be served in Mississipp. This is a serious matter. You need to take action as soon as

possible. The longer you wait, the more

lenient the Court may be on taking action against

your ex. Will be happy to answer any more questions that you may have. The Court can

take no action, unless you bring this to the

Court's attention.
