Legal Question in Family Law in Illinois
Hi
I have a question regarding my court order (child visitation). My ex-husband and I share joint custody of our 9-yr old daughter. My daughter resides with me.
He has visitation every other weekend and every Wednesday overnight. My ex-husband lives with his girlfriend and has recently started working nights. He insists on still taking our daughter on Wednesdays, but leaving her with his girlfriend.
Do I have the right to tell him he can still pick her up from school on Wednesday, but when he starts work that evening to bring her home? If he's not going to be there during his visit, I would rather my daughter be home with me instead of his girlfriend.
Would greatly appreciate any feedback.
Thanks for your time.

Turn the question around. If you decided to leave your child with a family member or boyfriend for several hours at night, would you want to be forced to to bring the child to the father's home? I am assuming the father sees her for some part of her time on Wed. And when she is sleeping, is her sleep affected by whether her father or his girlfriend is the one there?
All parents need to leave their kids with others as part of life, and they need to find good caregivers to help them. If the girlfriend is dangerous to the child its one thing, but it sounds like there is more to this then a concern about the child's welfare. Perhaps you are upset that he is having another woman watch your child. It is normal, as a mother, to feel threatened by that.
