questions about adoption

my husband was in jail when I gave birth. my questions are, did he have rights or were they taken and now that hes out does he have them back and can he get the child back and how does he go about doing that. thank you.

He does not lose rights as a father just because he was in jail. If it was a conviction that could be seen as endangering the safety of the child, that is another story.
